Here is whats going down......

Thanksgiving weekend.... my tranny goes out, you all heard me bitching about that
. SO I take my tuition money and look around for a tranny. I find this Jeep Parts place in Sacramento that says they will send me a good working tranny for my jeep for 750. I said ok cause my tuition for this semester was 900. So they send it saying 65 was the S&H rate. Then they says its 90. So whatever. I didn't care, my Jeep was gonna get fixed so I was happy. I get the tranny middle of December, have to wait a few weeks to put it in, Its in around Jan 10. Start it up, take off. SOmething is majorly wrong, it was slipping, dieing, everything. SO I bring it back, pissed off, take a week to look at everything myself, get tired of it all, take out a one thousand dollar loan to get it looked at by a Jeep Dealer. They tell me that it might be this one lil part, and if not the whole thing is crap, so the dealer calls the place where I got the Trannny, they say it has a 100 day warrenty, so they send that lil part to fix it. That wasn't it. SO the dealer says its somthing bad, so we will just have those people send you a replacement.....well JW jeep calls today and says that the dealer voided the warrenty by checking to see if if the tranny was bad by opening some valve. BUTTTTTT they will cut me a deal on a new tranny. HAHAHAHAHAH YA RIGHT. no thinaks, the warrenty says that the tranny they sent me is working and in good condition. Well it wasn't and now I have a authorized Jeep Mechanic from the local Jeep dealer saying it was crap to begin with. I can't take out any more money from my bank, and I work hard for the money I have just to go to school and keep making payment on somehitng I can't drive. This really pisss me off cause now they are trying to screw me in the ass and get more money outta me. WHAT SHOULD I DO??????????????

I would calmly tell them where to get off...

No really, you have a dealership on your side. They said ok the first time to the dealer "fixing" the problem, "the little part".

So now they basically are turnig around and saying that the dealership isnt authorized to work on a jeep tranny, i would refer to this post:

are you both in California? if so, file at small claims court ..... the max you can ask for here (North Carolina) is 4 grand in small claims court ..... file for the most they will let you .... make all of it legitimate costs, everything that you suffered... including lost time and interest on your loan and the cost of the Jeep dealership and if your not up to the maximum make the rest mental anguish ... trust me, when they get served the papers on that they will be in the mood to negotiate .... and if they don't give you what you want, you have a professional Jeep dealership on your side ...

Ya we are both in califrnia, I am on the boarder so my Jeep is in a Dealership in brookings, just across the boarder in Oregon. And yeah, thats what I should do...thanks. I have emotional detachment issues to. Hehehe. I tyhink a couple of D44s and some ARBs would be nice.

I hope you paid with credit card. You can dispute the original charge (most times up to 4 months back). This disputing this really works.

Then you can tell the credit card company what happened and let them sort it out.

Many times if you just call the place you bought the item from and tell them you are about to dispute it unless you get satisfaction, they step up and solve it. They know that most credit card charge disputes are in favor of the consumer.

Now that's a good one.
Better then threatening with a law suit that will only cost you money. It'll save you an ulcer. It gives you back initiative. And I wouldn't let those %$#@*& sell you anything again. Just return the bad tranny on their costs an tel them to screw themselves. If you paid any money on the dealer it's lesson money. (No idea how to put that in correct English.)

If you did pay by credit card use a charge back as a first approach. If you didn't use a credit card that small claims court will work. It costs $35 to file. You already have a certified mechanic proving that the tranny was crap to begin with. Second if the guy knew full well the tranny was crap then you have fraud you can throw at him, but that is a little harder to prove. Be sure to include in your filing the cost of the tranny, shipping, mechanic's fee, etc... Once you appear before the judge have all your proof in order. The seller may not even show up and you be awarded the monies owed. Usually the sheriff is the person who goes to the sellers business to collect. He can either give the sheriff the money or the sheriff can confiscate anything that has value that equals your award from the court. This does take a little time, but sometimes is the only resolution.

Tell the Jeep dealership that they are not a "Authorized Mechanic" for your Jeep according to the yard, and that they need to rectify the situation before the yard badmouths them all over the town.

If I were a Jeep dealer and told I wasn't authorized by a bunch of yard owners I'd go to town on them and claim millions in lost sales... then head to the Carribean.

Heres the update....

I called J&W today prepared to throw everything you guys have suggested at em. They told me that it was BEEP that they had to replace it when the dealership voided the warrenty...so they agian said that they weren't going to send an exchange... until I said well this is not my fault and now I have to take further actions and sent it was you guys that sent the bad transmisson in the first place, I will start will you. Thats when he said let me talk to the boss cause we never like to have a dissapointed customer...hehehe. So the boss came back on the phone very angry and siad the following..."I am going to send you a different tranny that I will check out myself to make sure it works... I want my old tranny on a crate and sent back here right when the replacement is recieved so I can see the "damage" that the this called "dealership" inflickted on my tranny." So i said ok... thank you.

Buhhahaaaa, no one likes the thought of "further action" taken against them. Just make sure you get the dealership to document everything, pictures if possible. At least he's sending you a replacement without making you pay for it up front, or without you sending him the unit back first. Now if he tries to argue that the damage was caused by the dealer, he'll have to be the one to take action, not you. I'm sure he won't be that motivated since he knows his place is really the one who messed up.

I was about to post a thought or two but it seems to be working out for you. It sounds to me that they new they were in trouble and at fault. If I new I sent a good tranny and someone else messed it up I wouldn't consider just sending you another. Good job... You handled yourself perfectly.
