CA Smog Nazis Lose BIG TIME!

/wwwthreads_images/icons/smile.gif A state appeals court overturned the $300 "Smog Impact' discouragement fee that CA has been soaking those who have bought used vehicles outa state. more than 250 million dollars have been bled out of hapless victims of the Smog Nazi/DMV consortium since September 1992. As I have said so many times, it isn't about smog....it's about MONEY! Finally, we have some relief. This is going to save us $300 bucks on our Connecticutt CJ that we bought to drive here in the **** state, and which we were going to have to get screwed on just like the others have been. If you have paid an "Impact Fee", you can get your dough back by applying to the DMV. Call 877-SMOG-FEE (toll free) for an application, or download one from www.wyca.com The DMV in CA has been historically the worst bunch of crooks in all of government. FINALLY, someone woke up and sued them and won! /wwwthreads_images/icons/laugh.gif This is good news for Jeepers especially.

Hey Dave, Would this apply to folks who had to pay the fee in the past, say 5 years, too? Do you know if it matters whether or not they still own the vehicle? I could definately use the dough! Thanks for the info!! Happy Jeepin'!

Get this, CA DMV is still charging the fee. I asked DMV about it today, all I was told was that a one time $300 smog impact fee was due. Not one word about being able to get it back. AAA said they still had to collect the fee, and I would have to apply to the state for a refund. AAA said they had no choice, CA still requires it to be paid. I guess they are hoping to steal some extra $$$ from everyone who doesn't hear about the ordered refunds.

What you want to do is stall, and take some more time. You don't have to pay that till the end when you get your plates. That's what we are doing with the SNOJEEP, we got the rest of the stuff, and are laying behind a log till the thirty days goes by. I bought my YJ in San Diego @ 1991 and thank goodness it was all stock. i did have a '69 firebird back then that was painful to smog, (and it ran good) anyway i feel for you california guys (and gals) unless you all want to drive around in bone stock TJ's call them congressmen.... (get some good referee stations and avenues for special cases /wwwthreads_images/icons/smile.gif

Two totally liberal women who made apologies for the scumbag, hate guns, SUVs, anything off-road, conservatives, anybody who can think, and all Christians. Just this very day, the pro-**** governor of this state inked into law the most far-reaching **** agenda ever passed into law. This is truly, the **** state now. /wwwthreads_images/icons/laugh.gif Oh, the tree-huggers are way ahead of you on the lawn mower issue, they even made corporate America some big bucks when they scared everyone into thinking that gas engine mowers would be outlawed, and some stores "offered" (out of the goodness of their heart) to trade in your perfectly good gas mower for a junky little "electric" so you could "save the world"... Meanwhile we have...what is it? 17 Million....tires burning here in CA, cancelling out all other smog mitigation efforts from 1952 on. What a joke. I tell ya, Yuppies; especially the tree-hug type; are without a doubt the most gullible of all consumers. Look at the Volvo myth. In reality the only class that Volvo leads in safety is the Mid-Sized Luxury class....because it is the ONLY station wagon IN the class. Volvo has a crash rating of 56, and there a slew of cars in the low fourties, along with a lot of SUVs. A Suburban is 41. So if you want your little donklins to be safe, take 'em to soccer practice in a Suburban, or a Buick Estate Wagon. If you hit a Volvo on the way, it's bad luck for the yuppie driving the Volvo. /wwwthreads_images/icons/frown.gif There would be mountain spring water bottles and cappuchino all over the intersection. /wwwthreads_images/icons/laugh.gif

Check out the site first (http://www.dmv.ca.gov)
They have 30 days to file the appeal in court. At which time the judgement to repeal the illegal $300 fee will be suspended. The DMV will then continue to collect the fee until they lose the appeal. The appeal process can take 6 to 12 months in a quick court.

ALSO, the CA DMV will not refund any fees if it has been more than 3 YEARS since you registered the vehicle. "This is due to the statute of limitations and the fact that the DMV's records are no longer available for verification." WELL I've got news for them, the statute of limitations STARTS at the time of DISCOVERY. (how do you think the IRS gets people for tax evasion) Just because they don't have my records doesn't mean I can't prove I paid the money. As long as I find my copy of the registration from 1988.

/wwwthreads_images/icons/crazy.gif This WAS an appeal. They lost. They have thirty days to file a motion. Meanwhile, keep getting extensions and lay behind a log till the thirty days goes by. They'll never get this appeal overturned, not now that they have been caught red-handed, and now that the outa state stuff is as smog-free as the CA junk is. /wwwthreads_images/icons/crazy.gif
