I sure am glad that this year is over. In the year of 2003 i had a total of 3 wrecks. All in my poor jeep. The first was early into summer i got rear ended pretty bad (6 months of PT) then about a month ago i get rear ended again when it was REALLY icy out. Then on the 28th of december i rear end someone. The guy was a jerk and it was not my fault but i'm sure it will end up that way. Anyway Looks like i'm going to have to wait for my lift kit.
Any my question to you guys is do you have any advice? The lanes were merging (right into left). I was in the left and he was suppose to merge into my lane. He squeezed in front of me and cut me off. So i honked at him then he slamed on his breaks and i rear ended him. Any thoughts? Both of our insureance companies are suppose to investigate.

My poor jeep. Bent my front bumper and sheered off one of the bolts. Bent something in my steering, not sure if its the box or a rod or what. All i have to say is its a damn good thing i have an old CJ. Anyother car would have been torn to pieces after all the crap its been put thru. Saved my life more than once.

Well the cops did come. But the only witnesses there were me and my girlfriend. His insurance company found me 100% at fault. I'm going to try and get my insurance company to fight it. Sure would like to see that $&%*#@ atlest fined some money.

DEFINITELY fight it. I had a guy do that to me once, for the same reasons, but I just tapped him. The cops warned him that because he INTENTIONALLY caused an accident, he could have been arrested, it's the same as assault. The insurance companies will play their game. In Maine if you hit a guy, you're at fault, except when there are mitigating circumstances, like I mentioned. There are exceptions to every rule.

At EMWF III, myself, my wife, Wyld Bill (zuk guy), his wife, and one of the people in the accident all gave statements to the State Trooper, who agreed it could not have happened any other way, that another guy was at fault 100%. Well, HIS insurance company said we were all lying, the police report was bogus, and refused everything. It was over a year before it was straightened out. The guy had to claim it against his own insurance company, then they had to go after the other guy. But, he was still out the $1,000 for his deductible.

Insurance companies will play their game, they have nothing to lose, and they will try to make you look as bad as possible in the process. Don't expect them to do anything honorable or above board, they're worse than doctors and lawyers, but not by much.

I have a feeling there is a little more to this story than what we are hearing. I could be wrong but its just not adding up.

I am not going to justify what this guy did. however i can say that if someone slams on the brakes in front of you and you hit them. it because you were following to close. whether it was intentional or not you where too close.

personaly if someone start to ride my tail i drive slower and slower. i may give him a tap of the brakes a time or two. but if he continues then a dog ran out in front of me.

like i said i am not going to justify it. But did the guy come over you honk he slams on the brakes all this in what 1 or 2 seconds or did you keep riding his tail for a few. maybe accompany the honk with a salute?

csjjeep,
what you are describing is road rage. why don't you just wave a hand gun out your window.

what purpose does flashing your brake lights serve other then to threaten someone else with possible deadly force ????????????????

its not OK.

no its not
flashing the brake lights is a polite way of telling a nondriver that he or she is endangering me the passengers in my car and other motorists. tailgating causes alot of accidents remember if i do have to slam on my brakes for a legitimate reason then you are following too close then they hit me. how is tapping the brakes to tell someone i do not appreciate their ignorance rage?

yes I agree, it is a real problem when idiots put you and your family in that kind of predicament. agresive driving is a real problem.

but face it. if they are tailgating they are already aggravated. your best move is to avoid them.

comitting agressive driving yourself will not get you and your passengers out of danger. it will higten it.

your only safe option is to apply the brakes slowly and alow the idiot to pass you.

sorry to harp on you.

i thank we are actually agreeing on this you read my original post in a different context that i meant it to be read. notice i said i go slower and slower. i do that hoping they will pass. when i said tap the brakes i meant i tapp enought so the lights come on not to slow quickly. the reason i said i think there is more to ths story is because i think tailgatting and blowing the horn at someone who just cut you off is road rage as much if not more than someone slamming the brakes in front of you.
So am i right do we agree?

Ok..Whole story

My girlfriend and I are on our way to GI Joes to pick up some new wiper blades. The roads are wet and the sky clear. You go thru a light and then about 75 yds after that light the lanes merge into one (right merges into the left the way it has been since i can remember). There is about a a car length between me and the guy in front of me. I was in the left lane BTW. There ware no cars behind me in my lane. The other guy who i hit passes me on my right and cuts in front of me. As soon as that happens i let off the gas and lay on my horn becuase i was upset with what he did (call it road rage or what ever you want). Then he looks in his mirror and slams on his breaks. Not just a tap but he applied enough breaks to make his 4runner learch forward. Then i slam on my breaks and turn my wheel to try and avoid him. My breaks lock up and my right bumper nails his left rear bumper. We both pull over i make sure my girlfriend is ok. She just has a sore back and neck but shes doing better now. He calls the cops and wont get out of his car till the cop gets there. The other guy gets out and starts taking digi pics with his camera. The cop goes back to see which lane is suppose to merge and comes back to tell me that there is no signs at all. Which there was he just didnt' go back far enough.

SO...it was his problem to merge i had teh right of way. There is absolutly no reason for him so squeez in infront of me. The lane was clear behind me. There is no doubt in my mind that he did it on purpose. If he were to tap his breaks just so the lights come on thats one thing, slaming them on so your whole cars lurches forward? Thats just asking for it. Thats just wrong if you ask me.

The other guys insruance has found me %100 at fault. I have yet to talk to my insurance company due the holidays. I intend to fight this thing to the bitter end.

I would see how far your insurance company will pursue this. Mention to them that you are going to speak to a lawyer about this also, unless their lawyers want to investigate it. Take a succession of pictures showing the merge sign up to where you hit him.
If you have Geico, consider yourself screwed. They will fold immediately no matter who is at fault.

Re: Ok..Whole story

make sure you tell your insurance carrier not to pay. once they pay it is over. unless you tell them then they have no reason to think it is not as cut and dry as a normal rear ender.

let them know that they will lose your business if they pay without taking a look and that the driver of the other car is intentionally committing fraud in your opinion.

Hey Adam- Sorry to hear about your wreck...good luck with your insurance co...just remember, don't sign any releases or anything until you're sure you understand what you're signing 100%.

Just in case...I have a perfect stock front bumper off my Scrambler you can have...and once you find out what else you need let me know, I might have it lying around.

Re: Ok..Whole story

That would be awesome. Not sure if i need a new one. I might post a picture. I know its something in my steering. Not sure if its the box or a rod or what.

Turns out that both the other guys insurance and my insurance are finding me %100 at fault. Nothing i can do about it. I fought it big time. No good tho. My insurance said the case wouldn't hold up at all. So i'm SOL i guess. Ohh well just have to wait and see howmuch they raise my rates. Who knows maybe they'll drop me.

Too bad beating the crap out of someone is illegal. He hurt the 2 things i care about most. My girlfriend and my jeep.

Happy Jeepin' All!

Re: Ok..Whole story

I had sort of the same thing happen to me one morning on the way to work. I was in the fast lane doing about 65 and the lane to the right of me was doing about 45 for some reason. Some guy from that lane just switched over in front of me and I had to slam on my brakes to not hit him. Then he looked in his rear view and saw that I was close to him so he slammed, and I mean SLAMMED his brakes on and almost caused a serious accident. I switches into the carpool lane in order to not hit him. After that I have a real problem with people that slam on their brakes in order to get you off of their tail. Not only are they endangering your life, but their own and anyone else that may be around them. Ive even seen someone following another car a bit too close and the guy in front just tap his brake. It was obvious that the guy following wasnt paying attention. He ended up swerving into the other lane and almost nailing the car next to him. For all of these reasons I always try to keep atleast a couple of car lengths between me and the next car.

Call me a wimp.

All these posts remind me of one thing...driving to work on the DC beltway. I see this crap every day. Makes me wish I could crive an M1 Abrahms to work, and just drive OVER the annoying people in front of me that are doing this kind of crud.
stupid drivers.
