Here's the down and dirty according to the Uniformed Code af Military Justice. That is the rules and regulations that govern all the military.
Article 88 Contempt Toward Officals
Any commissioned officer who uses contemptuous words against the President, Vice President, Congress, Secratary of Defense, Secretary of a Military Department, Secretary of Treasury, or Governor or Legislature of any state, territory, Commonwealth, or possession which he is on duty or present shall be punished as a court-martial may direct.
Now that just pertains to the commissioned officers. Us enlisted can be punished by the infamous Article 134, A General Article. Basically what that means is that if someone deams something that you did as bad and it is not covered in any of the other articles, you can be charged with Article 134.
Hope that clears it up. And in asking my leagal guy, the individual that you badmouth doesn't have to be present. Somebody just has to rat you out. Enlisted can even be charged for badmouthing commissioned officers and them not be around. I sure would have alot of charges against me for both.
