Dark brake fluid means replacing (at least every 2 years or more often). Shifting back problems usually indicate a well used or abused gearbox. First sign is always crushing backshifting from 3->2. Maybe the gearoil level is low and sometimes replacing the oil can make a little difference. It doesnt really sound as a clutch problem.
